Terms and Conditions for Brilliant Minds Advocacy Website

Welcome to the Brilliant Minds Advocacy website (“Site”). These Terms and Conditions (“Terms”) govern your access to and use of our website, including any content, functionality, and services offered on or through the Site. By accessing or using our website, services, or resources, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our site or services.
By accessing or using the Site, you acknowledge that you’ve read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you don’t agree to these Terms, you mustn’t access or use the Site.
1. About Brilliant Minds Advocacy
Brilliant Minds Advocacy is a culturally affirming organization that empowers autistic individuals, families, and communities. We provide hands-on guidance, resources, and education to foster confidence and understanding. Through our comprehensive suite of services, our goal is to equip and support you. We aim to empower families and autistic individuals to confidently navigate systems, secure appropriate support, and foster understanding and independence, offering practical advice, direct support, and effective representation in dealings with schools and other institutions.
2. Services Offered
Brilliant Minds Advocacy offers a variety of services, including but not limited to:
• IEP/504 Plan Assistance & School Advocacy: Direct support and representation in developing, reviewing, and advocating for effective IEPs and 504 plans. This also includes navigating general school-related issues, establishing partnerships with local schools, and addressing challenging situations. We can also accompany families to Child Study Team meetings.
• Parent Coaching: Providing strategies and support to parents to help them effectively advocate for and support their children’s needs.
• Resource Navigation: Helping families and individuals identify and access relevant resources.
• Autism-Friendly Business Designation: Consulting with businesses to help them create more inclusive and accommodating environments for individuals with autism.
• Workshops and Training: Delivering educational workshops and training sessions on topics related to special education, advocacy, and autism awareness for parents, educators, and community groups.
• Life Skills Coaching for Adults with Autism: Providing individualized coaching to adults with autism to develop essential life skills, foster independence, and achieve personal goals.
Specific details regarding the scope, fees, and duration of particular services will be outlined in a separate engagement agreement or service contract. This separate agreement will take precedence over these Terms in case of any conflict regarding the specific services provided to you.
3. Event Participation and Code of Conduct
If Brilliant Minds Advocacy hosts or facilitates any in-person or virtual events, workshops, or training sessions (“Events”), the following terms apply to your participation:
• Voluntary Participation & Assumption of Risk: Your attendance and participation in any Event are voluntary. You acknowledge and agree that participation in Events may involve inherent risks, including but not limited to, personal injury, property damage, or other losses, whether foreseeable or not. You voluntarily assume all such risks associated with your participation.
• Personal Responsibility: You are solely responsible for your own safety, well-being, and property during Events. You agree to exercise caution and adhere to all instructions provided by Event organizers or venue staff.
• Code of Conduct: You agree to conduct yourself in a respectful, professional, and non-disruptive manner at all Events. Discriminatory, harassing, abusive, or disruptive behavior towards other participants, staff, or presenters will not be tolerated. Brilliant Minds Advocacy reserves the right to remove any participant from an Event, without refund, who violates this Code of Conduct or whose behavior is deemed inappropriate or harmful.
• Media Release: You grant Brilliant Minds Advocacy the right to photograph, video-record, or otherwise capture your likeness, voice, or statements during Events, and to use such media for promotional, educational, or archival purposes, including on the Site and social media, without further compensation or notice to you. If you wish to opt out of media capture, you must notify Brilliant Minds Advocacy in writing prior to the Event or inform event staff at the time of the event.
• No Guarantees: Brilliant Minds Advocacy does not guarantee specific outcomes or results from participation in any Event.
• Event Changes/Cancellations: Brilliant Minds Advocacy reserves the right to modify, reschedule, or cancel any Event at its sole discretion, including for reasons beyond its control. In case of cancellation by Brilliant Minds Advocacy, registered participants will be offered a full refund or a credit for a future event.
4. Eligibility
Our services are available to individuals aged 18 and older. Parents and legal guardians may request services on behalf of their minor children.
5. Payments & Refunds
This section details our refund policy.
• All payments for services must be made in full prior to the start of service, unless otherwise agreed in writing through a formal engagement agreement.
• Fees are clearly listed on our website or provided in service agreements and are subject to change.
• Refunds are considered on a case-by-case basis and must be requested in writing within 7 days of the initial consultation.
6. Client Responsibilities
To ensure the best possible outcomes when engaging with our services, clients agree to:
• Provide accurate and complete information during intake and coaching sessions.
• Participate actively in sessions and follow up on recommendations.
• Respect appointment times and provide at least 24 hours’ notice for cancellations or rescheduling. This is our cancellation and rescheduling policy. Failure to provide sufficient notice may result in a charge for the missed session.
7. Privacy and Confidentiality
We are committed to protecting your privacy. Any personal information shared with us will be handled in strict accordance with our separate Privacy Policy and applicable data protection laws, including but not limited to the Family Educational Rights and Privacy Act (FERPA) where applicable. We maintain confidentiality regarding client-specific information and discussions within the bounds of professional ethics and legal requirements.
8. Intellectual Property
All content on this website, including but not limited to logos, text, graphics, videos, downloadable resources, workshop materials, training manuals, and the overall design, is the exclusive property of Brilliant Minds Advocacy and its creators. This content is protected by copyright, trademark, and other intellectual property laws. It may not be copied, reproduced, distributed, modified, or used in any form without our express written permission.
You may, however, print or download one copy of a reasonable number of pages from the Site for your own personal, non-commercial use, provided you do not remove any copyright or other proprietary notices.

• No Guaranteed Outcomes: While Brilliant Minds Advocacy provides dedicated educational consultants and advocacy support, our role is to empower and guide. We do not, and cannot, guarantee specific outcomes or results.

12. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Site or our services after such modifications will constitute your acknowledgment of the modified Terms and your agreement to abide and be bound by the modified Terms. We encourage you to review these Terms periodically for any updates.
13. Governing Law
These Terms are governed by and construed in accordance with the internal laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal or state courts located in Norfolk County, Massachusetts, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
14. Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
15. Entire Agreement
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Brilliant Minds Advocacy regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
